Most small landlords have made an agreement with a tenant while standing in a driveway, talking on the phone, or meeting a vendor at the house. That is normal. The trouble begins when the landlord and tenant walk away from the conversation with different versions of what was agreed to.

Welcome back to Landlord Legal Lowdown. In Texas, verbal agreements are not automatically meaningless. In fact, the Property Code defines a lease broadly enough to include written or oral agreements. That is exactly why landlords should be careful about what they promise and should confirm important changes in writing.

The Written Lease Still Sets the Starting Point

For most professional landlords, the written lease should be the operating document. It tells both sides when rent is due, who handles particular responsibilities, what notices are required, and how changes should be made. Many written leases also include an entire agreement clause stating that the written documents contain the parties’ agreement.

The parol evidence rule can limit the use of prior or contemporaneous oral statements to contradict a final written agreement. But landlords sometimes misunderstand that rule. It does not mean every later conversation disappears. A discussion that happens after the lease is signed can still become part of a dispute over modification, waiver, reliance, or the parties’ course of conduct.

There is another important limit. Texas Business and Commerce Code Section 26.01 generally requires a lease of real estate for a term longer than one year to be in writing and signed by the person against whom enforcement is sought. Shorter oral rental arrangements can still exist. The safest operating practice is not to assume that spoken words have no effect.

Rent Concessions Are Where Trouble Starts Fast

A common example is a temporary rent arrangement. A tenant calls and says they need until the tenth to pay. The landlord agrees on the phone, thinking it is a one time courtesy. A week later, the parties disagree about late fees, the due date, or whether enforcement was postponed.

Now the dispute is not simply about what the lease says. It is also about what each person remembers from the call. Even if the lease says modifications should be in writing, the conversation and later conduct may still become evidence. The landlord has created an unnecessary factual dispute that could have been avoided with a short written agreement.

If you decide to grant a concession, write down the exact amount, date, and terms. State whether the arrangement applies only to that month and whether any other lease provisions remain unchanged. For larger changes, use a signed amendment or payment agreement. The point is clarity, not paperwork for its own sake.

Maintenance Conversations Need a Written Follow Up Too

Maintenance creates a different kind of problem. A tenant may mention a slow leak while you are at the house, or call to say an electrical outlet is sparking. Under Section 92.052, a repair notice must be in writing only if the written lease requires written notice. That does not mean a landlord should ignore a serious condition simply because the tenant mentioned it verbally.

If a tenant tells you about a condition affecting health or safety, document the conversation and move the issue into your normal repair system. In DFW and North Texas, that might be an HVAC failure during extreme heat, a roof leak after hail or high winds, a burst pipe during a freeze, or an electrical problem after a severe storm. A follow up email or portal entry can confirm what was reported, when it was reported, and what action you took.

The legal question and the management question are not always the same. A tenant may later need to prove statutory notice to obtain a particular remedy. You still need to manage the property responsibly once you know about a problem.

Put the Agreement in the File

A good rule is not “verbal agreements do not count.” Texas law is more complicated than that. A better rule is that any agreement important enough to change the money, the lease, the condition of the property, or either party’s obligations is important enough to confirm in writing.

After a phone call or driveway conversation, send a short written summary. If the tenant disagrees, you will find out immediately. If the tenant agrees, you have a record. If the change is significant, use a signed amendment rather than relying on the summary alone.

That simple habit is especially useful for landlords managing houses across the Metroplex and surrounding North Texas communities, where you may not see the tenant in person again for months. Clear written follow up keeps a casual conversation from turning into competing memories later.

The best documentation is often created before anyone thinks there is a dispute.
